The privacy policy set out below explains how Lister Pharmacy uses and protects the information that is provided to it.

Unless the context otherwise requires, references to “you” or “your” within this privacy policy shall be a reference to you and/or your organisation. References to “Application Form” within this privacy policy shall be a reference to the standard forms used by Lister Pharmacy (as may be amended from time to time without notice) to obtain information about you prior to commencing a trading relationship.

Lister Pharmacy reserves the right to update and amend this privacy policy at any time without notice. You are responsible for reviewing the privacy policy on each occasion that you visit the Website, and if you continue to use the Website after amendments have been made then you are deemed to have accepted the amendments.

If you follow a link from the Website to a third party’s website, this privacy policy will no longer apply. Lister Pharmacy is not responsible for the information handling practices of any third party websites and recommends that you read the privacy policy specific to such websites.

By creating an account or using the Website you agree to the collection, use and disclosure of your information by Lister Pharmacy under the terms of this privacy policy.

2. Collection of Information

In order to provide you with the services you require, we will collect personal information about you from our website, telephone conversations, emails and written and verbal communications.

We will only use the information that we collect about you lawfully (in accordance with the General Data Protection Regulations (GSPR)(EU) 2016/679).

We collect information about you for the following reasons:

• – To process your order;
• – To provide you with the best service possible and to inform you regarding any future products/services that we will offer in the future;
• – To record details of all medicines and other products we supply to you, and medicines that you or your doctor tells us you may have from us on repeat prescription.

The type of information that we will collect about your register on the website are:

• – Information gathered by the use of cookies in your web browser. To deliver the best possible web experience, we collect technical information about your internet connection and browser as well as the country, where your computer is located, the pages viewed during your visit, the advertisements you clicked on , and any search terms you may enter on our platform.

We will not email you unless you have given us your consent. If you are already subscribed to receive our marketing emails, you may opt at any time by clicking on the unsubscribe link at the end of every email we send you.

3. Use of Information by Lister Pharmacy

If you open an account on the Website the information you provide will be used by Lister Pharmacy to verify your identity, to create an account and to process any orders for goods and/or services received, the provision of health care or treatment, the management of health care systems, or necessary for reasons of public health in the area of public health.

If Lister Pharmacy open an account for you, we will use the information provided to administer your Account.

Unless you have expressly asked us not to do so, Lister Pharmacy may use information provided for marketing purposes, to undertake marketing analysis and to make general improvements to the Website and our products and services.

Lister Pharmacy will keep your information secure by taking appropriate measures against its unauthorised or unlawful processing and against its accidental loss, destruction or damage. Lister Pharmacy will retain your information for as long as it is needed for the purposes set out in this privacy policy or as otherwise required by law.

4. Disclosure of information by Living Care Pharmacy to third parties

Lister Pharmacy may share your information with credit reference agencies and other third parties (as described at section 4 above). Lister Pharmacy may also share your information with any of our associated organisations or business partners for administrative purposes and so that any information or goods or services you have requested can be provided.

Lister Pharmacy may also share your information with any organisation that buys or is interested in buying our business or assets, or to whom Lister Pharmacy transfers its agreement with you, and in the course of any negotiations that may or may not lead to such a transfer or sale.

Lister Pharmacy may allow third party providers and contractors who supply goods or services to us or who process information on our behalf incidental access to your information. In such circumstances, we will endeavour to ensure that such third parties keep your information secure and do not use it for their own purposes.

Lister Pharmacy will disclose any information provided if required to do so by law (such disclosure may be to enforcement authorities or to a third party in the context of actual or threatened legal proceedings) to the extent so required. Unless permitted or required to do so by law, we will not otherwise share, sell or distribute any of the information provided to us by you without your consent.

5. Cookies

The Website uses cookies to distinguish you from other users of the Website and to provide increased functionality when you are using the Website. This helps Lister Pharmacy to provide you with a better experience when you browse the Website and allows us to improve the Website.

Cookies are small data files that most website operators place on the browser or hard drive of their user’s computer. Cookies may gather information about the user’s use of the website or enable the website to recognise the user as an existing customer when he returns to the website at a later date. A “cookie” is the name of a message given by a web server to a web browser and is a small file of letters and numbers. The message is then stored by the web browser in a text file called “cookie.txt” and can be removed from your system at any time. Each time the web browser requests a page from the web server, this message is sent back. Living Care Pharmacy uses cookies to collect information from the Website but we will not collect any information about you except in accordance with this privacy policy and as required for the system administration of the Website server.

Consent

Under the 2003 Regulations as originally drafted, the user also had to be given the opportunity to refuse the storage of, or access to, such cookies. However, following the coming into force of the 2011 Regulations, website operators must now obtain the users’ consent to the use of cookies (Regulation 6(2)(b), 2003 Regulations as revised by the 2011 Regulations). The 2011 Regulations do not include any detailed provisions on how user consent should be obtained. However, the Information Commissioner has issued guidance on the practical steps providers can take to comply with the new obligations. If a user accepts cookies from the site, it might makes sense for the website operator to store that preference (for example, by setting a “cookie acceptance” cookie on the user’s browser or hard drive) to avoid the need to obtain consent again when the user next visits the site. The 2003 Regulations allow website operators to make the user’s access to certain web pages dependent on his acceptance of cookies. As a matter of good practice, the user should be informed, however, that restrictions on his use of the website apply if he decides to reject cookies.

We use the following categories of cookies:

1. Strictly necessary cookies. These are cookies that are required for the operation of our website and to enable you to access certain services on the Website. They include, for example, cookies that enable you to log into secure areas of our website.

2. Analytical/performance cookies. These cookies collect anonymous information on pages visited and allow us to recognise and count the number of visitors and to see how visitors move around the Website when they are using it. This helps us to improve the way the Website works, for example, by ensuring that users are finding what they are looking for easily.

3. Functionality cookies. These cookies are used to recognise you when you return to the Website to improve your use of the Website. This enables us to personalise our content for you, greet you by name and remember your preferences (for example, your choice of language or region).

The above cookies also fall into 2 categories – session or persistent. Session cookies expire at the end of your browsing session (when you leave the Website) and persistent cookies expire at a specified time in the future.

Third-party cookies

Since they do not have a direct relationship with the user, third parties (for example, advertising networks) that want to place cookies on users’ equipment through a website that they do not operate themselves will find it difficult to provide users with the necessary information and to obtain valid consent. The Information Commissioner’s guidance therefore raises the possibility that third parties may wish to consider including a contractual obligation into their agreements with website owners that imposes an obligation on those website owners to satisfy themselves that appropriate steps will be taken to provide information about the third-party cookies and obtain consent.

Given that they have no control over the cookies set by their advertisers, website owners should ideally reject such an obligation. Instead they should bring the fact that third parties may be given access to the website for the purpose of setting cookies to the user’s attention without being seen to accept any liability for the third party’s compliance with its legal obligations. You have the right to see any of the information we hold about you on payment of a statutory fee (currently £10.00). You also have the right to correct any errors in the information we hold about you; please inform us of any changes you would like to be made to your details so that we can keep our records accurate and up to date.

You have the right to opt out of receiving any marketing material from us at any time by sending a written request to us or by clicking the unsubscribe link within our communications.
